Who Is Collecting Your Personal Data

TRIBUTARY BOTANICALS, LLC ("Tributary," "us," "we," or "our") offers and maintains the website(s) located at www.tributarybotanicals.com and www.tributarybotanicals.myshopify.com, including all subdomains and subparts, as well as our social media accounts on Facebook, Instagram, and other platforms (collectively, the “Site”).  When you visit the Site, you may choose to provide us with personal data that identifies you.  This Privacy Policy describes how we collect, process, use, and disclose your personal data, and it applies regardless of how you access or use the Site.

Minors

The Site is not intended for individuals under the age of eighteen. We do not intentionally collect personal data from children. If you are a parent or guardian and believe your child has provided us with personal data, please contact us at support@tributarybotanicals.com to request deletion.

What Personal Data We Collect

When you provide it to us, we collect information that identifies you (“Personal Data”), such as your:

Much of this Log Data does not identify you personally. However, we may associate this Log Data with your Personal Data. When we do, we will treat any such combined data as Personal Data until such time as it can no longer be associated with you or used to identify you.

    • Purpose of collection: to load the Site accurately for you and to perform analytics on Site usage to optimize our Site.
    • Source of collection: collected automatically when you access our Site, using cookies, log files, web beacons, tags, or pixels.
    • Disclosure for a business purpose:  shared with our processor, Shopify.
    • Personal Data collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.
  • Order information
    • Purpose of collection: to provide products or services to you to fulfill our contract, process your payment information, arrange for shipping, provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
    • Source of collection: collected from you.
    • Disclosure for a business purpose: shared with our processor, Shopify, PayPal, or other processor, depending on the payment method.
    • Personal Data collected: name, billing address, shipping address, payment information (including credit card numbers), email address, or phone number.
  • Customer support information
    • Purpose of collection: to provide customer support.
    • Source of collection: collected from you.
    • Disclosure for a business purpose: shared with Shopify.
    • Personal Data collected: email or phone number.

How We Use Your Personal Data

We use your Personal Data to provide our services to you, which includes offering products for sale, processing payments, and shipping and fulfillment of your order.

We use your Personal Data for purposes for which you provided it, including to:

  • fulfill your product and service needs
  • provide customer service to you
  • register your online account
  • maintain our own accounts for delivery
  • advise you about new products, services, offers, and events that may be of interest to you

We may also use your Personal Data or Log Data to administer our internal business activities, including to:

How We Share Your Personal Data

We share your Personal Data with service providers to help us provide our services and fulfill our contracts with you, as described above.

Behavioral Advertising

Because Tributary is on the Shopify commerce platform, we or Shopify may use your Personal Data to provide you with targeted advertisements or marketing communications we believe may be of interest to you, as described above. For example:

  • We share information about your use of the Site, your purchases, and your interaction with our ads on other websites with our advertising partners. We collect and share some of this information directly with our advertising partners, and in some cases through the use of cookies or other, similar technologies (which you may consent to, depending on your location).
  • We use Shopify Audiences to help us show ads on other websites with our advertising partners to buyers who made purchases with other Shopify merchants and who may also be interested in what we have to offer. We also share information about your use of the Site, your purchases, and the email address associated with your purchases with Shopify Audiences, through which other Shopify merchants may make offers you may be interested in.

Sharing Personal Data with Affiliates, Successors, and Agents

For purposes consistent with this Privacy Policy, we may share your Personal Data with:

  • successors who acquire your Personal Data if we sell, merge, reorganize, dissolve, or similarly change our ownership or corporate structure

Sharing Data through Social Media

We work with social media sites like Facebook, YouTube, Instagram, Pinterest, Twitter, and Google, and with application developers who specialize in social commerce, so you can connect to us, share your interests, express opinions about products and services, purchase our products, and generate interest in our products and services among members of your social networks. 

Using these integrated tools enables you to share your Personal Data with other individuals or the public, depending on the settings that you have established with social networking websites. If you use third-party social media features available on our Site, we or the third party may collect or share your data, including your Personal Data.  

If you do not want us to be able to access information about you, including Personal Data, from third-party sites, you must limit data collection and disclosure in the privacy settings on the third-party sites. We reserve the right to remove the Personal Data or other data of any person for any reason we, in our sole discretion, deem appropriate.

Legally Compelled Disclosure of Personal Data

We may disclose your Personal Data if required to do so by law or in our good-faith belief that such action is necessary to:

How Long We Keep Your Personal Data

When you place an order through the Site, we will maintain your order information for our records unless and until you ask us to delete this information. However, we may still retain your Personal Data for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data, it may persist on backup or archival media for an additional period of time.

How You Can Resolve a Privacy Dispute with Us

If you have a complaint about this Privacy Policy or our privacy practices, we will work with you in an attempt to resolve your complaint.  Please contact us at support@tributarybotanicals.com.  Please also refer to the arbitration procedures described in our Terms and Conditions. 

BY CLICKING TO COMPLETE YOUR TRANSACTION AND ACCEPT THESE TERMS BEFORE SUBMITTING YOUR PERSONAL DATA TO US, WE EACH AGREE TO SETTLE DISPUTES ONLY BY NON-CLASS, INDIVIDUAL ARBITRATION, INSTEAD OF SUING IN COURT (EXCEPT CERTAIN SMALL CLAIMS AS DETERMINED BY TRIBUTARY).  

To initiate an arbitration proceeding, you must send us a notice of your complaint that includes a written statement of your name, address, and contact information, the facts giving rise to your complaint, and the relief you are requesting (the “Dispute Notice”).  The Dispute Notice must be addressed to:  TRIBUTARY BOTANICALS, LLC, 4314 Fauquier Avenue, PO Box 170, The Plains, VA 20198 and sent to us by certified mail as described in the Dispute Resolution section of the Site’s Terms and Conditions.  If we do not reach an agreement to resolve your privacy complaint within sixty (60) days after we receive your Dispute Notice, you may commence an arbitration proceeding under the Dispute Resolution section of the Site’s Terms and Conditions.
